Key notes from a recent wrc case about Force Majeure

The wording of the legislation is somewhat ambiguous. Even the courts struggle to define it in practice.

It does not state, but this particular case appears to have been brought as 'a matter of principle'. This is not uncommon with wrc cases. 

Or perhaps to win it to set the standard for future requests in this particular workplace.

A key contributor to her winning her case was that the employer had granted it before for similar circumstances.  To note from this: If you start something as an employer. Like giving employees a concession or benefit. Even unintentionally, you can set a standard or a precedent in your workplace. It can be very difficult to withdraw the benefit or concession at a later stage.
