Section 28 of the Safety, Health and Welfare at Work Act 2005 - Penalisation.

15/09/2024
Penalisation complaints to the WRC are quite common. Basically, that someone has been subjected to detriment or unlawful treatment in the workplace because they raised Health and Safety concerns.

Complaints being submitted out of time and therefore not being permitted for a hearing in the WRC, is also quite common.

The time limit for claims is 6 months. In certain circumstances an extension may be granted, but this should not be relied on.

The full WRC case can be read here.
